Welcome to Halalmi.de. These Terms of Use & Marketplace Terms (“Terms”) govern your access to and use of halalmi.de, including our website, customer accounts, seller accounts, product listings, checkout, order management, reviews, wishlists, comparison lists, newsletters, support services, vendor tools, and related marketplace features.

Halalmi is an online marketplace for halal and halal-friendly products. The platform allows customers to discover and purchase products and allows independent sellers to list and sell products through Halalmi.

Please read these Terms carefully before using Halalmi. By accessing our website, creating an account, placing an order, submitting content, applying to become a seller, or selling products through Halalmi, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use Halalmi.

If Halalmi appoints a separate legal representative, product safety contact, Digital Services Act contact point, or dispute contact, those details may be published separately on our website.

2. Definitions

In these Terms:

“Halalmi,” “we,” “us,” or “our” means the operator of halalmi.de.

“Platform” means halalmi.de and all related marketplace features, account features, seller tools, checkout systems, product pages, content areas, support tools, and services.

“Customer” means a person or business that browses, orders, purchases, reviews, or otherwise uses products or services through Halalmi.

“Consumer” means a natural person who uses Halalmi mainly for purposes outside their trade, business, craft, or profession.

“Seller,” “Vendor,” or “Merchant” means an independent business, trader, or approved seller that lists, offers, sells, or fulfills products through Halalmi.

“User” means any visitor, Customer, Seller, account holder, reviewer, or other person using the Platform.

“Products” means goods, digital items, gift certificates, or services offered through Halalmi, where applicable.

“Content” means text, images, product descriptions, reviews, questions, comments, seller profile information, logos, videos, files, or any other material submitted, uploaded, displayed, or transmitted through the Platform.

“Order” means a purchase request submitted through Halalmi.

“Seller Terms” means the seller-specific terms in these Terms and any additional seller agreement, fee schedule, seller dashboard rules, product policies, or marketplace policies accepted by a Seller.

3. Scope of these Terms

These Terms apply to:

use of halalmi.de; customer accounts; seller accounts; browsing and search; product pages; order placement; payment processing; delivery and fulfillment; returns and refunds; product reviews; wishlists; comparison lists; gift certificates; promotions; newsletters; vendor registration; seller dashboard use; seller product listings; marketplace communication; customer support; and any other service we make available through Halalmi.

Additional terms may apply to specific features, promotions, payment methods, delivery options, gift certificates, seller services, or product categories. If additional terms apply, they will be provided where relevant and become part of your agreement with us.

If there is a conflict between these Terms and specific additional terms, the specific additional terms apply to the relevant feature or transaction.

Your statutory consumer rights are not limited by these Terms.

4. Halalmi’s role as a marketplace

Halalmi provides an online marketplace that enables independent Sellers to offer Products to Customers.

Unless Halalmi is clearly identified as the seller of a Product, the sales contract for a Product is formed directly between the Customer and the relevant Seller. In that case:

the Seller is responsible for the Product, product description, price, halal claims, certifications, legal compliance, delivery, defects, statutory warranty, returns, refunds, customer service, invoices, tax obligations, product safety, and recall obligations; and Halalmi provides marketplace technology, listing visibility, ordering tools, payment facilitation, communication tools, and customer support assistance.

Halalmi may also sell Products directly. Where Halalmi sells a Product directly, Halalmi will be identified as the seller and will be responsible for that sale as required by law.

Halalmi may assist with communication, refunds, returns, disputes, product safety issues, or customer service, but this does not automatically make Halalmi the seller of third-party Products.

5. Eligibility and minors

You may use Halalmi only if you can legally enter into a binding agreement or if you use the Platform with permission and supervision from a parent or legal guardian.

If you are under 18, you may use Halalmi only with the consent of a parent or legal guardian. By using Halalmi as a minor, you confirm that your parent or legal guardian has agreed to these Terms on your behalf.

Sellers must be legally capable of operating a business and entering into commercial agreements. Individual Sellers must be at least 18 years old. Business Sellers must be properly authorized to act on behalf of their business.

6. Accounts and registration

You may need an account to use certain features, including placing orders, tracking orders, using wishlists, using comparison lists, submitting reviews, applying as a Seller, or managing seller listings.

You agree to provide accurate, complete, and current information when creating or using an account. You must keep your account information updated.

You are responsible for maintaining the confidentiality of your login details and for all activity under your account, unless the activity was caused by our failure to apply legally required security measures.

You must notify us immediately if you believe your account has been accessed without authorization.

We may refuse registration, suspend access, request verification, or close an account where necessary to protect Users, Sellers, customers, the Platform, legal compliance, or marketplace integrity.

7. Acceptable use of the Platform

You may use Halalmi only for lawful purposes and in accordance with these Terms.

You must not:

use the Platform for illegal, fraudulent, misleading, harmful, or abusive purposes; provide false account, order, payment, seller, certification, product, or identity information; interfere with the security, availability, or proper operation of the Platform; attempt to access accounts, systems, data, or areas of the Platform without permission; use bots, scrapers, crawlers, automated extraction, or similar tools without our written permission; copy, reproduce, resell, or exploit the Platform or its content without permission; upload viruses, malicious code, spam, phishing content, or harmful files; submit fake reviews, manipulated ratings, or misleading product questions; impersonate another person, company, Seller, customer, or representative; infringe intellectual property, privacy, publicity, or other rights; harass, threaten, abuse, defame, or discriminate against others; bypass payment, commission, fee, verification, seller, or platform rules; or use Halalmi in a way that harms customers, Sellers, Halalmi, or third parties.

We may remove content, restrict features, cancel orders, suspend accounts, or take other appropriate action if we reasonably believe these Terms or applicable law have been violated.

8. Product information, halal claims, and availability

Product information may include names, descriptions, ingredients, allergens, images, prices, certifications, halal status, seller details, delivery estimates, sizes, colors, quantities, usage instructions, safety warnings, and other information.

For third-party Products, Sellers are responsible for ensuring that product information is accurate, complete, lawful, up to date, and not misleading.

Halalmi may review, edit, reject, remove, or request changes to product listings, especially where listings appear inaccurate, unsafe, unlawful, misleading, incomplete, non-compliant, or inconsistent with Halalmi’s marketplace standards.

Halal-related claims must be accurate and supported. Sellers must not describe a Product as halal, halal-certified, alcohol-free, pork-free, vegan, cruelty-free, organic, natural, modest, ethically sourced, or compliant with any religious, dietary, legal, or certification standard unless they can prove the claim.

Halalmi may request certificates, supplier declarations, ingredient lists, audit evidence, product labels, or other supporting information. Failure to provide satisfactory evidence may result in listing removal, order cancellation, seller restriction, or account suspension.

Product availability is not guaranteed. Products may be unavailable, discontinued, incorrectly listed, delayed, restricted, or removed.

9. Food, cosmetics, wellness, and product safety information

Halalmi may offer or allow Sellers to offer food, beverages, cosmetics, personal care products, baby products, wellness products, household products, fashion items, Islamic lifestyle products, and other categories.

Product information on Halalmi is not medical advice, nutritional advice, religious advice, or professional advice. Customers should read product labels, ingredients, warnings, expiry dates, allergen information, and usage instructions before using any Product.

Customers with allergies, intolerances, health conditions, pregnancy-related concerns, medication interactions, or special dietary requirements should check the Product information carefully and seek professional advice where appropriate.

Sellers are responsible for complying with applicable food, cosmetic, product safety, labeling, advertising, consumer protection, and halal-certification laws.

Halalmi may remove or restrict Products that are unsafe, recalled, illegal, misleading, incorrectly labeled, counterfeit, or otherwise unsuitable for the Platform.

10. Prices, taxes, shipping costs, and errors

Prices are shown on the Platform in the currency displayed at checkout. Unless stated otherwise, prices include applicable VAT for consumer sales where required by law.

Shipping costs, delivery charges, taxes, customs duties, import fees, payment charges, and other costs may be shown separately before checkout confirmation.

Sellers are responsible for the accuracy of their Product prices, tax settings, delivery charges, and invoice information.

We try to prevent pricing, availability, description, and technical errors, but errors may occur. If a Product is listed with an obvious error, incorrect price, incorrect description, incorrect shipping fee, or incorrect availability, we or the Seller may cancel or correct the Order where legally permitted.

If an Order is cancelled after payment because of an error or unavailability, the paid amount will be refunded using the original payment method unless another lawful method is agreed.

11. Orders and contract formation

By placing an Order, you make a binding offer to purchase the selected Product or Products from the relevant Seller or from Halalmi where Halalmi is the seller.

Before submitting an Order, you will have the opportunity to review key order information, including Product details, price, shipping costs, delivery address, payment method, and total amount.

A sales contract is formed when the relevant Seller or Halalmi accepts your Order. Acceptance may occur through an order confirmation, dispatch confirmation, delivery confirmation, or another clear acceptance notice, depending on the checkout flow and Product type.

An automatic acknowledgement of receipt of your Order does not necessarily mean that the Order has been accepted, unless the acknowledgement clearly states that the Order has been accepted.

We or the Seller may reject or cancel an Order where legally permitted, including where:

the Product is unavailable; the listing contains an obvious error; payment is not authorized; fraud or misuse is suspected; delivery is not possible; required age, identity, address, or compliance checks are not passed; the Product cannot legally be sold or delivered; the Seller cannot fulfill the Order; or the Order violates these Terms or applicable law.

12. Payment

Payment methods available on Halalmi may vary. You must provide accurate and authorized payment information.

Payments may be processed by third-party payment service providers. Your use of a payment method may also be governed by the terms and privacy policy of the payment provider, bank, card issuer, wallet provider, or other financial service provider.

Where payment is processed through Halalmi or a payment provider on the Platform, Halalmi or the payment provider may collect payment on behalf of the relevant Seller.

We may perform or request fraud, identity, payment, delivery, or security checks before accepting or fulfilling an Order.

If payment is reversed, charged back, declined, disputed, or suspected to be fraudulent, we or the Seller may suspend fulfillment, cancel the Order, restrict the account, or request additional information.

13. Delivery, shipping, risk, and ownership

Delivery options, shipping costs, estimated delivery times, and delivery restrictions may vary by Seller, Product, delivery address, carrier, and availability.

Delivery dates are estimates unless expressly stated as binding. Delays may occur due to stock issues, weather, carrier delays, customs, public holidays, incorrect addresses, force majeure events, or other circumstances beyond reasonable control.

For consumer purchases, risk of loss or damage generally passes to the Customer when the Customer or a third party designated by the Customer, other than the carrier, receives the goods.

For business purchases, risk may pass earlier, including when goods are handed to the carrier, unless mandatory law provides otherwise.

Ownership of Products passes according to applicable law and the relevant sales contract, usually after full payment and delivery, unless otherwise stated.

Customers are responsible for providing accurate delivery details and ensuring that delivery can be accepted.

14. Cancellations before dispatch

You may request cancellation of an Order before dispatch or fulfillment. Cancellation is not guaranteed once processing, preparation, dispatch, personalization, or fulfillment has started.

If the Seller or Halalmi accepts the cancellation, any paid amount will be refunded as required by law.

For perishable goods, customized goods, sealed hygiene goods, digital content, or other special Products, cancellation may be limited once preparation or performance has begun.

Your statutory right of withdrawal, where applicable, remains unaffected.

15. Consumer right of withdrawal

If you are a Consumer in the European Union or another jurisdiction with statutory withdrawal rights, you may have the right to withdraw from eligible distance contracts within 14 days without giving a reason.

The right of withdrawal is subject to legal exceptions. For example, withdrawal rights may not apply, or may expire early, for certain perishable goods, goods made to customer specifications, sealed goods that are not suitable for return for health or hygiene reasons once unsealed, sealed audio/video/software items once unsealed, digital content where performance has begun with required consent, or other legally excluded categories.

If a third-party Seller is the contractual seller, withdrawal should normally be addressed to that Seller. Halalmi may provide tools or support to help process the withdrawal.

16. Returns and refunds

Returns and refunds are handled according to applicable law, these Terms, the relevant Seller’s return policy, and the Product type.

For eligible consumer withdrawals, refunds will be processed in accordance with legal requirements after the valid withdrawal request and, where applicable, after the returned goods are received or proof of return shipment is provided.

Unless the Seller agrees otherwise or the law requires otherwise, Customers may be responsible for return shipping costs if they were informed of this responsibility before purchase.

Products must be returned with reasonable care. Customers may be responsible for loss in value caused by handling beyond what is necessary to inspect the nature, characteristics, and functioning of the Product.

Refunds are generally made using the original payment method unless another method is agreed and lawful.

Shipping fees may be refunded only to the extent required by law. Additional costs resulting from choosing a delivery method more expensive than the standard delivery option may not be refundable unless required by law.

17. Defective Products and statutory warranty rights

Customers may have statutory rights if Products are defective, not as described, not fit for purpose, unsafe, damaged, incomplete, or otherwise non-compliant with the contract.

For third-party Products, the Seller is responsible for statutory warranty claims and remedies. Halalmi may assist with communication and dispute handling.

Nothing in these Terms limits mandatory statutory warranty rights, product liability rights, consumer rights, or rights arising from a voluntary guarantee.

Any commercial guarantee, manufacturer warranty, halal certificate, quality mark, or seller promise is additional to statutory rights and applies only according to its own terms.

18. Gift certificates, vouchers, and promotions

Halalmi may offer gift certificates, discount codes, coupons, promotional credits, free shipping offers, or other promotions.

Promotions may be subject to additional conditions, including validity periods, minimum order values, excluded categories, excluded Sellers, one-time use restrictions, non-transferability, or limits per Customer.

Promotions cannot be exchanged for cash unless required by law.

We may cancel, refuse, or reverse a promotion where it is used fraudulently, unlawfully, in breach of the promotion terms, or due to an obvious technical error.

19. Reviews, ratings, questions, and user content

Halalmi may allow Users to submit reviews, ratings, product questions, comments, images, seller feedback, or other Content.

By submitting Content, you confirm that:

the Content is accurate and based on your genuine experience where applicable; you have the right to submit it; it does not infringe third-party rights; it is not unlawful, misleading, abusive, discriminatory, defamatory, obscene, threatening, spam, or fake; it does not contain confidential or sensitive personal data; and it complies with these Terms.

You grant Halalmi a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, host, store, reproduce, display, publish, translate, moderate, adapt, and distribute your Content for operating, promoting, improving, and protecting the Platform.

We may remove, reject, edit, hide, rank, label, or moderate Content where we reasonably believe it violates these Terms, applicable law, platform rules, or review integrity standards.

We do not guarantee that reviews are complete, accurate, or representative of all customer experiences.

20. Notice and action for illegal content or products

If you believe that content, a Product, a listing, a Seller, a review, or other material on Halalmi is illegal, unsafe, counterfeit, misleading, infringing, or otherwise violates these Terms, you may notify us.

Notices should be sent to:

A notice should include:

your name and contact details; the URL or clear location of the content or Product; the reason you believe it is illegal, unsafe, infringing, or non-compliant; supporting evidence where available; and a statement that your notice is accurate and submitted in good faith.

We may review the notice, request more information, remove or disable access to content, restrict Products, contact the Seller, notify affected Users where required, or take other appropriate action.

Users and Sellers affected by a moderation, restriction, removal, suspension, or termination decision may contact us to request review of the decision.

21. Search, ranking, recommendations, and promotions

Halalmi may display Products, Sellers, categories, search results, recommendations, “popular” items, “bestsellers,” promotions, ratings, or other marketplace content in a particular order.

Ranking may be influenced by factors such as:

search terms; product title and description relevance; category match; price; availability; delivery options; customer ratings; sales activity; return rates; seller performance; product quality; listing completeness; halal certification or claim evidence; stock level; customer location; newness; promotions; sponsored placement where offered; fraud prevention; safety concerns; and technical performance.

The relative importance of ranking factors may vary depending on the feature, search query, category, customer context, and marketplace needs.

If paid advertising, sponsored placements, or promoted listings are introduced, they should be clearly identified where required by law.

Halalmi may give different treatment to Products sold by Halalmi, affiliated sellers, preferred partners, or promoted Sellers only where disclosed and lawful. Where Halalmi sells its own Products, it may access platform data needed to operate the marketplace and may use aggregated or operational data to improve the Platform, subject to applicable law and the Privacy Policy.

22. Intellectual property

The Platform, including its design, layout, logos, trademarks, graphics, text, software, database structure, categories, icons, images, and other materials, is protected by intellectual property and other laws.

You may use the Platform only as permitted by these Terms.

You must not copy, modify, distribute, reproduce, sell, license, reverse engineer, publicly display, scrape, extract, or exploit any part of the Platform without our prior written permission, except where allowed by mandatory law.

Sellers and Users retain ownership of Content they submit, but grant Halalmi the license described in these Terms.

Sellers must ensure that product images, brand names, logos, descriptions, certificates, and other listing materials do not infringe third-party intellectual property rights.

We may remove or restrict Content or listings that appear to infringe intellectual property rights.

23. Third-party services and links

The Platform may include links or integrations with third-party websites, payment providers, shipping providers, map services, newsletter providers, social media platforms, analytics tools, or seller websites.

Third-party services are operated by third parties and may be subject to their own terms and privacy policies.

Halalmi is not responsible for third-party services unless required by law.

Seller Terms

The following Seller Terms apply to all Sellers, Vendors, Merchants, applicants, and business users who apply to sell or sell Products through Halalmi.

24. Seller application and approval

To sell on Halalmi, you must apply for a Seller account and provide all information requested by Halalmi.

We may approve, reject, suspend, or require additional verification for a Seller application where necessary to protect customers, comply with law, verify identity, assess product suitability, or maintain marketplace standards.

Approval as a Seller does not guarantee ongoing access to the Platform, sales volume, ranking, traffic, visibility, or acceptance of any Product listing.

You must not create multiple Seller accounts, transfer your Seller account, or allow another person or business to use your Seller account without our written permission.

25. Seller verification and trader traceability

Sellers must provide accurate, complete, and current business information, including where applicable:

legal business name; trading name; business address; contact person; email address; telephone number; tax number; VAT ID; commercial register details; beneficial owner information; bank or payout details; identity documents; product compliance information; halal certification evidence; and self-certification that Products comply with applicable EU and German law.

We may verify Seller information through documents, public registers, databases, payment providers, tax checks, identity checks, or other lawful methods.

Sellers must promptly update their information if it changes.

If a Seller fails to provide or update required information, or if we cannot verify the information, we may restrict listings, suspend payouts, pause selling privileges, remove Products, or suspend the Seller account.

26. Seller status and seller-of-record responsibility

Unless Halalmi expressly agrees otherwise in writing, each Seller is the seller of record for Products it lists and sells through Halalmi.

Each Seller is responsible for:

Product legality; Product safety; Product quality; halal claims and certificates; product descriptions; images and listing content; prices and stock levels; taxes and VAT; invoices; delivery; customer service; statutory warranty; withdrawal rights; returns; refunds; complaints; product recalls; and all legal obligations related to its Products and sales.

Sellers must comply with all applicable laws, including consumer protection, ecommerce, product safety, food, cosmetics, labeling, tax, VAT, packaging, environmental, advertising, intellectual property, competition, sanctions, data protection, and halal-related laws.

27. Seller Product listing requirements

Sellers must ensure that each listing is accurate, lawful, clear, complete, and not misleading.

Each listing must include all legally required information, where applicable, including:

Product name; Product description; price; VAT information; shipping costs; delivery time; seller identity; ingredients; allergens; expiry or best-before information; country of origin; manufacturer/importer/responsible person information; warnings; age restrictions; size, quantity, weight, or volume; usage instructions; halal certification details; safety information; conformity information; return restrictions; and any other mandatory consumer information.

Sellers must keep inventory, delivery times, pricing, and Product information updated.

Sellers must not manipulate listings, duplicate listings improperly, use irrelevant keywords, misuse brands, submit false certificates, copy other Sellers’ content without permission, or misrepresent Product origin or quality.

28. Halal claims by Sellers

Halalmi is built around trust in halal and halal-friendly Products. Sellers must treat halal-related claims with special care.

A Seller must not make any halal-related claim unless the claim is truthful, specific, and capable of being proven.

Where a Product is described as halal-certified, the Seller must hold valid evidence from a recognized or appropriate certifying body and must provide it to Halalmi on request.

Where a Product is halal-friendly but not formally certified, the Seller must avoid misleading customers and must clearly state the basis for the claim, such as ingredient information, supplier declaration, manufacturing process, or absence of certain ingredients.

Sellers must promptly notify Halalmi if a Product’s halal status, certification, ingredients, supplier, manufacturing process, or compliance status changes.

Halalmi may remove or restrict any Product where halal claims are unclear, unsupported, disputed, expired, misleading, or inconsistent with platform standards.

29. Prohibited and restricted Products

Sellers may list only Products that are lawful, safe, authentic, properly labeled, and suitable for Halalmi.

Sellers must not list, offer, sell, or promote Products that are:

illegal; unsafe; recalled; counterfeit; stolen; misleadingly labeled; infringing intellectual property rights; prohibited by EU or German law; prohibited by Halalmi policies; non-compliant with product safety requirements; falsely described as halal; or otherwise unsuitable for a halal-focused marketplace.

Halalmi may prohibit or restrict categories including, without limitation:

weapons or dangerous goods; controlled substances; illegal drugs; tobacco or nicotine products; alcohol products; adult-only products or content; gambling-related products or services; counterfeit goods; products that promote hatred or extremism; unsafe children’s products; recalled products; medical products sold without required authorization; prescription-only products; products with unlawful health claims; products violating food, cosmetics, product safety, or labeling rules; and any Product that Halalmi reasonably considers harmful to customers, Sellers, or marketplace trust.

This list is not exhaustive. Halalmi may update prohibited or restricted Product rules at any time where necessary for safety, law, payment provider rules, marketplace standards, or brand protection.

30. Seller pricing, taxes, invoices, and records

Sellers are responsible for setting accurate Product prices, VAT settings, tax treatment, invoices, receipts, and accounting records.

Sellers must comply with all applicable tax, VAT, invoicing, and reporting obligations in every jurisdiction where they sell.

Sellers authorize Halalmi and its service providers to collect, process, store, verify, and report Seller and transaction information where required by tax, platform reporting, anti-fraud, payment, or marketplace laws.

If Halalmi is required to report Seller information or transaction data to tax authorities, Sellers must provide all required information and cooperate with verification checks.

Sellers are responsible for any taxes, penalties, interest, claims, or costs arising from their sales, tax classification, invoice errors, or failure to provide accurate information.

31. Seller fees, commissions, and payouts

Seller fees, commissions, payment processing fees, subscription fees, advertising fees, refund charges, chargeback charges, or other amounts may apply as shown in the Seller dashboard, seller agreement, fee schedule, or written notice from Halalmi.

Halalmi may deduct applicable fees, commissions, refunds, chargebacks, penalties, customer credits, taxes, claims, or other amounts from Seller payouts where permitted by the seller agreement and applicable law.

Payout timing may depend on payment confirmation, delivery status, return windows, fraud checks, chargeback risk, reserve requirements, verification status, or legal obligations.

Halalmi may withhold, delay, suspend, or offset payouts where reasonably necessary due to suspected fraud, legal claims, customer refunds, chargebacks, product safety issues, tax obligations, seller verification issues, breach of these Terms, or marketplace risk.

Sellers remain responsible for Orders even if payout is delayed, withheld, reversed, or subject to dispute.

32. Seller fulfillment and customer service

Sellers must fulfill Orders promptly, professionally, and in accordance with the delivery times and shipping options shown to Customers.

Sellers must:

maintain accurate stock levels; package Products safely and appropriately; use lawful and reliable shipping methods; provide tracking where available; respond to customer messages within a reasonable time; process cancellations, returns, refunds, and warranty claims lawfully; comply with cold-chain, food, cosmetic, fragile-item, or special handling requirements; and keep Halalmi updated about order status.

Sellers must not ask Customers to bypass Halalmi checkout, pay outside the Platform, cancel and reorder outside Halalmi, or communicate in a way that avoids marketplace fees or protections.

33. Seller returns, withdrawal rights, and warranty obligations

Sellers must comply with all applicable consumer withdrawal, return, refund, statutory warranty, and complaint handling laws.

Sellers must provide legally required withdrawal information and must honor valid withdrawal requests.

Sellers must cooperate with Halalmi where Halalmi provides an online withdrawal function, return workflow, customer support tool, or refund process.

Sellers must not refuse lawful consumer rights.

If a Product is defective, unsafe, not as described, missing parts, damaged, wrongly delivered, or otherwise non-compliant, the Seller must provide remedies required by law.

34. Product safety, recalls, and illegal Products

Sellers must ensure that Products comply with applicable product safety rules before listing and while selling.

Sellers must maintain required safety documentation, supplier information, manufacturer/importer information, batch records, certificates, test reports, conformity declarations, responsible-person information, warnings, and recall procedures.

Sellers must immediately notify Halalmi if:

a Product is unsafe; a Product is recalled; a Product is reported to an authority; a certificate expires or is withdrawn; a labeling or safety issue is discovered; customers report serious incidents; the Seller becomes aware of counterfeit, contaminated, defective, or non-compliant Products; or the Seller cannot prove legal compliance.

Halalmi may remove listings, stop sales, notify customers, cooperate with authorities, issue safety notices, process refunds, preserve records, or take other action where product safety or legal compliance requires it.

Sellers must cooperate fully with Halalmi, authorities, customers, payment providers, carriers, and manufacturers in relation to safety issues, recalls, investigations, and corrective actions.

35. Seller content license

By submitting Product listings, images, logos, descriptions, certificates, brand materials, or other Seller Content, the Seller grants Halalmi a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, display, distribute, translate, adapt, promote, and otherwise process that Content for operating, marketing, improving, and protecting the Platform.

Sellers confirm that they own or have all rights needed for the Content they submit.

Sellers are responsible for claims arising from their Content, including claims for copyright, trademark, design, image rights, database rights, privacy, unfair competition, misleading advertising, or false certification.

36. Seller performance standards

Halalmi may monitor Seller performance to protect customers and marketplace quality.

Performance factors may include:

order defect rate; cancellation rate; late shipment rate; return rate; refund rate; customer complaints; response time; product safety reports; review manipulation; listing accuracy; certificate validity; delivery reliability; chargebacks; compliance history; and customer satisfaction.

Halalmi may issue warnings, request corrective action, reduce visibility, remove listings, pause selling privileges, hold payouts, or suspend accounts where performance falls below marketplace standards or legal compliance is at risk.

37. Seller restriction, suspension, and termination

Halalmi may restrict, suspend, or terminate a Seller account, Product listing, payout, or marketplace access where justified by law, these Terms, marketplace integrity, customer protection, safety, fraud prevention, or legal compliance.

Grounds may include:

illegal Products; unsafe Products; counterfeit Products; false halal claims; repeated customer complaints; serious breach of these Terms; failure to verify identity or business information; tax or payment risk; intellectual property infringement; review manipulation; fraud; chargebacks; misuse of customer data; failure to fulfill Orders; refusal to honor consumer rights; product safety concerns; authority requests; sanctions risk; or repeated policy violations.

Where required by applicable platform-to-business rules, Halalmi will provide Sellers with a statement of reasons for restrictions, suspensions, or terminations and an opportunity to clarify facts through the complaint process, unless this would conflict with legal obligations, fraud prevention, security, or repeated serious violations.

For full termination of Seller access, Halalmi will provide advance notice where required by law, unless immediate action is allowed or required because of legal obligations, serious breach, repeated violations, fraud, safety risks, or urgent marketplace protection.

38. Seller complaint handling

Sellers may submit complaints about:

technical issues affecting their Seller account; Halalmi actions affecting their listings, sales, payouts, visibility, or account; alleged non-compliance with marketplace obligations; suspension, restriction, or termination decisions; ranking, search, or visibility concerns; or other marketplace-related issues.

Seller complaints should be sent to:

A Seller complaint should include:

Seller name; Seller account email; affected listing or Order number; description of the issue; relevant dates; supporting evidence; and requested solution.

Halalmi will review Seller complaints fairly and within a reasonable time, taking into account the complexity and urgency of the issue.

If Halalmi is legally required to operate a formal internal complaint-handling system or publish complaint statistics, additional information may be made available on the website or Seller dashboard.

39. Seller mediation

Where required by applicable platform-to-business law, Halalmi will identify mediators with whom it is willing to engage for disputes with Sellers that cannot be resolved through the Seller complaint process.

Mediation is voluntary unless mandatory law provides otherwise. Halalmi and Sellers must participate in good faith where mediation is used.

Nothing in these Terms prevents Halalmi or a Seller from bringing legal proceedings before a competent court.

If Halalmi qualifies for a small-enterprise exemption from mandatory mediation identification requirements, this section may apply voluntarily only.

40. Seller data access and data use

Sellers may access certain data needed to fulfill Orders, manage listings, provide customer service, process returns, and comply with legal obligations.

Sellers must use customer data only for permitted purposes, including order fulfillment, customer communication related to Orders, warranty handling, returns, refunds, legal compliance, and product safety.

Sellers must not use customer data for unrelated marketing, resale, profiling, external advertising, or contacting customers outside the transaction unless the Customer has lawfully consented or the law permits it.

Sellers must comply with data protection law and Halalmi’s Privacy Policy.

Halalmi may access Seller and transaction data to operate the Platform, process payments, provide support, improve services, enforce policies, prevent fraud, comply with tax reporting, comply with law, and protect marketplace integrity.

41. Seller indemnity

To the extent permitted by law, Sellers agree to indemnify and hold Halalmi harmless from claims, losses, damages, fines, penalties, costs, and expenses arising from:

Seller Products; Seller Content; false or misleading listings; false halal claims; product safety issues; recalls; defective Products; customer claims; tax or VAT failures; intellectual property infringement; data protection violations; misuse of customer data; illegal Products; failure to honor consumer rights; breach of these Terms; or violation of applicable law.

This indemnity applies only to the extent the Seller is responsible for the relevant issue under applicable law.

General Legal Terms

42. Privacy and personal data

Our processing of personal data is described in our Privacy Policy.

By using Halalmi, you acknowledge that personal data may be processed for purposes such as account management, order processing, seller verification, payment, delivery, customer support, fraud prevention, product safety, legal compliance, and marketplace operation.

Sellers must handle customer personal data lawfully and only for permitted transaction-related purposes.

43. Platform availability and changes

We aim to keep Halalmi available and functional, but we do not guarantee uninterrupted access.

We may update, modify, suspend, discontinue, repair, or restrict parts of the Platform for reasons including maintenance, security, legal compliance, technical improvements, fraud prevention, marketplace quality, or business changes.

We may change or remove features, categories, payment methods, delivery options, Seller tools, ranking systems, or policies where reasonable and lawful.

Changes will not affect completed Orders unless required by law or necessary to resolve safety, fraud, or compliance issues.

44. Account suspension and termination for Users

We may suspend or terminate a User account, restrict access, cancel Orders, remove Content, or block use of the Platform where reasonably necessary because of:

breach of these Terms; fraud or suspected fraud; payment issues; misuse of the Platform; illegal activity; security risk; abuse of Sellers, customers, or staff; false information; repeated returns abuse; review manipulation; intellectual property infringement; product safety risk; legal obligation; or harm to marketplace integrity.

Where appropriate, we may give notice and an opportunity to respond. Immediate action may be taken where needed for security, safety, fraud prevention, legal compliance, or urgent marketplace protection.

You may stop using Halalmi at any time. Registered Users may request account closure, subject to outstanding Orders, legal obligations, fraud prevention, accounting records, and dispute handling.

45. Disclaimers

The Platform is provided on an “as available” basis.

We do not guarantee that:

the Platform will always be uninterrupted, error-free, or secure; all Product information submitted by Sellers is accurate; Products will always be available; search results will be complete or unchanged; reviews will represent every customer experience; or a Seller will always meet customer expectations.

For third-party Products, Halalmi does not manufacture, inspect, test, certify, own, or control every Product listed by Sellers unless expressly stated.

Nothing in these Terms excludes or limits statutory rights, consumer rights, warranty rights, product liability rights, or liability that cannot be excluded under applicable law.

46. Limitation of liability

Nothing in these Terms limits or excludes liability for:

intentional misconduct; gross negligence; injury to life, body, or health; liability under mandatory product liability law; fraud; fraudulent concealment; guarantees expressly given; or any liability that cannot be limited under applicable law.

For slight negligence, Halalmi is liable only for breach of essential contractual obligations. Essential contractual obligations are obligations whose fulfillment enables proper performance of the contract and on whose compliance the User regularly relies. In such cases, liability is limited to typical, foreseeable damage.

For free-of-charge Platform features, Halalmi’s liability may be limited to the extent permitted by law.

The above limitations also apply to Halalmi’s legal representatives, employees, agents, service providers, and subcontractors.

Customers’ mandatory statutory rights remain unaffected.

47. Indemnity by Users

To the extent permitted by law, you agree to indemnify Halalmi from claims, losses, damages, penalties, costs, and expenses arising from your unlawful use of the Platform, breach of these Terms, infringement of third-party rights, fraudulent conduct, or unlawful Content.

This applies only to the extent you are responsible under applicable law.

48. Sanctions, export control, and legal compliance

You must not use Halalmi in violation of sanctions, export control laws, trade restrictions, anti-money-laundering laws, anti-terrorism laws, or other legal restrictions.

Sellers must ensure that Products, payments, deliveries, suppliers, customers, and business activities comply with all applicable sanctions and trade laws.

We may refuse, cancel, restrict, or report transactions where legally required or where sanctions, fraud, or compliance risks exist.

49. Changes to these Terms

We may update these Terms from time to time.

Changes may be made to reflect legal changes, new features, seller rules, consumer rights, payment methods, safety obligations, marketplace policies, or business changes.

The updated Terms will be posted on Halalmi with a new “Last updated” date.

For registered Users or Sellers, we may provide notice of material changes by email, account notice, Seller dashboard notice, or website notice where required.

Changes do not affect Orders already accepted before the change unless required by law or necessary for safety, fraud prevention, or legal compliance.

If you do not agree to updated Terms, you must stop using the Platform. Sellers may need to stop selling or close their Seller account if they do not accept updated Seller Terms.

50. Governing law

These Terms are governed by the laws of Germany, excluding conflict-of-law rules, unless mandatory consumer protection laws of another jurisdiction apply.

If you are a Consumer, this choice of law does not deprive you of mandatory consumer protections in your country of habitual residence where those protections apply.

51. Jurisdiction

If you are a Consumer, legal claims may be brought in the courts available under applicable consumer protection and jurisdiction laws.

If you are a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction, where legally permitted, is Hamburg, Germany.

Halalmi may also bring claims against Sellers or business Users in any other legally competent court.

52. Consumer dispute resolution

Unless we expressly state otherwise, Halalmi is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board under the German Consumer Dispute Resolution Act.

This does not affect your right to bring claims before a competent court.

53. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions remain valid and enforceable.

The invalid provision will be replaced by a valid provision that most closely reflects the economic and legal purpose of the original provision, where legally permitted.

54. No waiver

If we do not enforce a provision of these Terms immediately, this does not mean we waive our right to enforce it later.

Any waiver must be made in writing to be effective.

55. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

Halalmi may transfer or assign its rights and obligations where legally permitted, including in connection with a merger, restructuring, sale, transfer of business, or change of operator, provided that consumer rights are not reduced.
